Rental Agreement

By booking time at a property owned or managed by Suite Harmony (Calabogie House, Trailhead Lake House, Heron Lodge), and Calabogie Pearl Chalet guests agree to adhere to the HOUSE RULES and RELEASE & WAIVER OF LIABILITY & INDEMNITY AGREEMENTS below.


House Rules

THIRD PARTY BOOKINGS: We would love to host whoever you are booking for, but need those who make the booking to be in attendance during the stay.

BOOKING AGE: Guests over 25 years old are welcome to manage the booking. Please reach out with a special request for approval if you would like to book and are 24 years old or younger.

ADDITIONAL GUESTS: We require the number of expected guests at the time of booking. For safety reasons, please notify us if your guest count changes.

EARLY CHECK-IN/ LATE CHECK-OUT: Might be permitted when requested in advance if schedules allow.

PET POLICY: No pets allowed. When evidence of pets is found on the property, guests forfeit their deposit, and are charged for any additional cleaning.

NO SMOKING: No smoking of any kind is permitted indoors, in or around the pool or hot tub, or within 15 feet of the house. To reduce the risk of fire, and to maintain the appearance of the property, smoking debris must be removed from the grounds. Butts or other evidence of smoking will result deposit forfeiture, and charges for any additional cleaning.

PARTIES & EVENTS: Notify the owners in advance of parties and events to obtain approval. When hosting events, all house rules apply, including those related to conduct, noise and guest count.  Calabogie House has a dedicated event space and encourages gatherings when notified in advance.

NOISE: Guests at all Suite Harmony properties are bound by the noise by-laws in their township.

While Trailhead Lake House and Heron Lodge offer much privacy, there are other cottages nearby. Please keep outdoor noise to a respectful level. Quiet hours are between the hours of 2100 hours of one day and 0600 hours of the next day. The houses are equipped with Minut noise monitoring.

Calabogie House offers more flexibility for noise levels, as it sits on over 90 acres. 

SEPTIC: The houses are on a septic system. The septic system is very effective; however, it will clog up if improper material is flushed. Flush only toilet paper and natural waste. Please do not flush feminine hygiene products, wipes, paper towels, tissues, etc. not even "flushable" items.

SECURITY: Security is super important to us, our guests, and our neighbours.
Do not share your door access code outside of your guest group.
There are outdoor surveillance cameras on site for your safety and security. The surveillance cameras do not record sound.
Trailhead Lake House and Heron Lodge are equipped with Minut to monitor noise levels and safety issues like smoke on the premises. Minut does not record sound or video.
Do not tamper with, obstruct, or remove security items.

NATURE: Suite Harmony properties are situated in a natural setting. If you or any of your guests are uncomfortable with natural creatures, this area is not the right choice for you. You will not be reimbursed for issues involving natural creatures, spiderwebs, slug trails, birds etc. We also ask that all guests respect nature by not leaving trash on the grounds or feeding wildlife.

SAUNA

For those at Trailhead Lake House with access to the sauna.  To ensure your safety, and to keep the sauna in good condition:

- Only use tap water, to create steam. No pool or hot tub water, as the chlorine can damage your health and the sauna

- Drink water before entering, and after exiting the sauna

- Unsupervised use by children is prohibited

- Do not touch the heater

- No smoking while inside the sauna

- No exercise inside the sauna

- It is recommended that you remove your phone, watch and other electronics before entering

- Drinking alcohol before or during your time in the sauna can create health risks

- Seek approval from your doctor before using the sauna if you're pregnant or have heart concerns

- Only remain in the hot sauna for 10-15 minutes

HOT TUB & POOL
For those with access to a hot tub and/or pool. To ensure your safety, and to keep the hot tub and pool in good condition, please:

- Shower with soap and water before you come in.

- Enter slowly (don't jump or dive).

- Keep glass away from the hot tub and pool. Use plastic glasses provided.

- Do not eat in the hot tub or pool.

- Only enter the hot tub if the temperature is under 104°F.

- Limit your soak in the hot tub to 15 minutes, and cool off before re-entry.

- Those with heart disease, diabetes, high or low blood pressure, any serious illness, or pregnancy should consult their doctor before entering the hot tub.

- Replace hot tub cover after each use.

- Do not sit or lie down on pool cover or hot tub cover.

- Turn off high jets on hot tub after use.

- Do not add anything to the water (e.g.; soaps, oils or bubble bath)

- Do not smoke in the hot tub or pool

AMENITIES and SAFETY: Use of all amenities, including but not limited to kayaks, canoes, paddle boats, row boats, other watercraft, dock, lake, pool, hot tub, fire pit, fireplace, and sauna carry risk that may result in serious injury or death. Unsupervised use by children is prohibited.

LAKE SAFETY:
- All persons must wear life vests when in or around the lake.

- The shoreline, and area surrounding the dock is shallow. Do not dive into the lake, as this may result in serious injury or death.

- Never use the lake (including dock, kayaks, canoes, paddle boats, row boats, other watercraft, lakeside fire pit) while under the influence of drugs or alcohol.  

- Use of the lake (including dock, kayaks, canoes, paddle boats, row boats, other watercraft, lakeside fire pit) carries risk that may result in serious injury or death. Unsupervised use by children is prohibited.

- Follow all house rules throughout visit, including when in and around the lake.

NO TAPE, GLITTER or CONFETTI: Glitter and confetti are very difficult to clean up. Please do not tape things to our walls as the  paint peels off the walls when trying to remove the tape. Please use white sticky putty instead.

SHORT TERM RENTAL VS. HOTEL: You'll be staying in our home - filled with necessities to ensure a comfortable stay. Unlike a hotel, we ask that you keep our home tidy and in good condition. Kindly notify us of anything that has been damaged or broken during your stay.

ROAD CONDITIONS: No refunds will be given for storms or road conditions. Roads can be curvy and steep. Gravel drives are well maintained; however, we highly recommend four-wheel drive during the snow months.

Guests agree to exercise caution and take reasonable steps to ensure safety, including:

  • Wearing appropriate footwear for snow and ice,

  • Using the snow shovels, sand, and/or ice melter products provided at the property, and

  • Promptly reporting any hazardous conditions (such as excessive ice buildup or uncleared snow) to Suite Harmony or its representatives.

Guests are responsible for ensuring their vehicles are in good working order and equipped with appropriate tires for rural Ontario road conditions. The surrounding roads can be curvy, steep, and challenging in all seasons. Guests are expected to drive with caution and adjust their driving to accommodate potentially slippery or difficult conditions.

INFANTS AND CHILDREN: Infants and children of all ages are welcome. Note that equipment and safety items such as stair gates, child-proof locks, cribs, high chairs, etc. are not provided. Guests are to bring their own equipment as required.

CODE OF CONDUCT: Inappropriate conduct includes and is not limited to violence, verbal or physical abuse, violating any part of this agreement, loud music or noise that disturbs others, unauthorized services, programs or gatherings. Those non-compliant with conduct will be dismissed without refund.

Release & Waiver of Liability & Indemnity Agreement

IN CONSIDERATION for being permitted to enter the property for vacation rental or any other purpose, the booking party, herein referred to as the "RENTER", for themselves, guests, and invitees, acknowledge, agree, and represent that they have or will immediately upon entering, and will continuously thereafter, thoroughly inspect the property and associated amenities, including provided watercraft for safety. Their continued presence constitutes an acknowledgement that they have inspected house, deck and entire property and finds and accepts such areas as being safe and reasonably suited for their use, and they further agree and warrant that if, at any time, they feel anything to be unsafe, they and all guests will immediately leave the area and advise appropriate persons.

THE RENTER hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Suite Harmony (2831675 Ontario Inc.) personally or as company or corporate representatives, their members, managers, operators, officials, officers, directors, employees, owners and lessees of the premises, all for the purposes herein referred to as "releasees", from all liability to the renter, guests, representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demand thereof on account of INJURY to the person(s) or property or resulting in DEATH of the undersigned or guests, whether caused by negligence of the releasees or otherwise while in or upon the area.

THE RENTER hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area and whether caused by the negligence of the releasees or otherwise.

WARNING: Use of all amenities, including but not limited to kayaks, dock, lake, pool, hot tub, fire pit, fireplace, and sauna carry risk that may result in serious injury or death. Unsupervised use by children is prohibited. All persons must wear life vests when in or around the lake. Never use a canoe, kayak, dock, lake, pool, hot tub, sauna, fire pit,fireplace, or sauna while under the influence of drugs or alcohol. Follow all house rules when using amenities

DO NOT WALK ON HOT TUB or POOL COVER as it will collapse. Supervise children at all times to decrease risk of injury or drowning.

SNOW AND ICE MAINTENANCE:
The Renter and their guests acknowledge that while reasonable efforts are made to maintain safe conditions on the property — including snow plowing, sanding, and/or shoveling — Suite Harmony and its associates are not liable for any injuries, damages, or losses to persons or property resulting from snow, ice, or winter-related conditions.

While every effort is made to remove snow and ice in a timely fashion, guests understand that weather conditions, snow removal demands, or other factors beyond Suite Harmony’s control may cause delays in clearing walkways, driveways, or other areas.

The Renter and their guests assume full responsibility for their own safety and that of their guests when entering, exiting, or occupying the property during winter conditions.

By entering the premises, guests waive all claims against Suite Harmony, its owners, agents, employees, contractors, and affiliates for any accident, injury, or damage arising from or related to snow, ice, road conditions, or winter travel to or on the property.

THE RENTER hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of the releasees or otherwise while in or upon area.

THE RENTER hereby certifies that they and guests have adequate insurance to cover any injury, illness or damage that may be caused or suffered while in or upon area, or else agrees to bear the costs of such damage or injury. The renter further that they have no medical conditions which would interfere with use of hot tub, swimming, canoeing, hiking, climbing stairs, etc. or else assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or death and/or property damage. The renter further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Any dispute, controversy or claim arising out of or related to this Agreement or the interpretation of this Agreement shall be settled by arbitration in accordance to Canadian law, except to the extent modified below. The place of arbitration shall be Ottawa, Canada.

THE UNDERSIGNED HAS READ, UNDERSTANDS THE RISKS, AND VOLUNTARILY AGREES TO THE RELEASE AND WAIVER OF LIABILTY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.

SHORT TERM RENTAL AGREEMENT / CONTRACT

RENTAL TERMS AND CONDITIONS

All conditions listed above, along with the following:

1. Check-in & check-out times outside of standard 4:00 PM, 11:00AM on page 1, is not available in the summer months and is subject to owner’s written approval.

2. All Optional Amenities such as “Spa Rental, etc” are covered under the following terms and conditions.

3. Guests are required to bring everything you will consume during your stay. This including but is not limited to food items, herbs and spices, firewood for fire pit, garbage bags, extra drinking water, septic safe single ply toilet paper, etc. While the owner endeavours to provide a starter kit of essential items, it is the responsibility of the guest to supply all consumable items during your stay.

4. Cleaning fee of $250 plus $50 administration fee at a minimum will be deducted from the security deposit if the cottage or optional amenities are not left clean and tidy as per the owner’s expectation detailed in the cleaning checklist.

5. The cottage is a SMOKE FREE residence. Smoking is not allowed inside the cottage OR within a ten feet radius of any buildings or structures. Any damage due to cigarettes, vaping, including damages to exterior deck, buildings or any property will be deducted from your security deposit.

This many include fumigation costs for the entire cottage due to smoke damage from improper use of equipment including wood stove, lingering tobacco, cigarette smell, or any illegal substances.

6. In the event that any unreasonable rowdiness or noise occurs such that leads to repeated complaints by others, the renter(s) shall vacate the premises immediately upon the owner’s request, and forfeit the balance of the prepaid rental. Noise should be lowered at 11:00 PM.

7. Pets are NOT PERMITTED. Any evidence of pet damage will result in a forfeiture of the full security deposit.

8. “Security / Damage Deposit” will be returned in full, after reconciling any direct and indirect related expenses (Phone, Propane, Clean-up, Garbage Disposal, etc.) and subject to no loss or damage having occurred during the contracted rental period.

9. Renter(s) agree to be responsible for, and reimburse the Owner(s), in full, within 90 days, for any and all repairs to damage, even that which exceeds the Security/Damage Deposit.

10. Depending on the time of year, rental may include the use of flotation devices and small boat/s. (Note: P.F.D.’s and Boater’s Safety Kit required by law)

11. The property owner and / or personnel representing the owner shall be allowed access to the cottage at any reasonable time during the renter(s) occupancy.

12. The maximum number of occupants using the cottage premises shall not exceed the total number stated in the information and application form, or monetary penalties shall be removed from the security deposit. Visitors or day guests are NOT permitted.

13. The Renter(s) agree that the cottage is solely for their recreational purposes only and no commercial, sub-letting, or other activity shall be carried on.

14. The Renter(s) consent to the owners of the cottage being rented, the right to verify all information and references provided in this application.

15. Renter(s) acknowledge that the cottage is supplied with well water. The tap water is directly from the well and is not potable (but can be used for washing dishes, flushing toilet, brushing teeth, etc.) but NOT drinkable. We provide a 5 gallon cooler drinking water as a start. The small tap in the Pearl Chalet kitchen on the right of the sink is fitted with a filter which makes this the ONLY tap with potable water. The renter(s) must supply any additional drinking water require.

16. The environmental envelope around the cottage is rich, diverse and includes animals and insects that are sometimes undesirable to some people. These creatures are part of nature. The owners have taken every precaution to prevent unseemly visitors from the cottage. Therefore the owners do not accept such irritations as grounds for cancellation of a rental and/or a refund of monies.

17. The owners have endeavoured to ensure all information respecting the cottage is current and accurate and the cottage is suitable for recreational use. The owners do not warrant or guarantee the quality of the cottage as this is basically a subjective opinion.

18. The renter(s) acknowledge(s) that the chalet is equipped with an outdoor ring camera that is clearly visible to the Renter(s). This is to monitor security and to apprise the owner of unauthorized access.

19. Rental excludes the use of the owner’s personal watercraft and motorized boats, the Lakeside Chalet or the grounds of the Lakeside Chalet (please respect the fence that demarks the cottage grounds), all outbuildings on the property, the oversized garage and owner’s property stored in the outbuildings or any items under lock and key within the cottage. The forced entry of renter into the owner’s personal effects is considered breaking and entering. Since this is a criminal offence these activities will be prosecuted to the full extent of the law.

20. Linen and towels may be available for rent at an additional cost over and above your rental cost and must be arranged and paid for under this contract. Please note that additional charges will apply for stains or damages to linen or towels. Please consult the Renter Hand Book for a schedule of fees.

21. Renter(s) acknowledge that the Owners accept no liability for loss, damage, death, illness, or injury suffered by the renter(s) and/or his/her guests as a result of using this rental. The Renter(s) acknowledges that the use of the property is entirely at the Renter(s) own risk. The Renter(s) shall indemnify and hold harmless the Owner’s against and from any and all expenses, costs, damages, suits, actions or liabilities arising from any and all loss of or damage to personal

property, injury, personal condition or death resulting from the use of the rental property, grounds, boats and lake use. The owner carries insurance on dwelling and contents, not the property, valuables, or clothing of the Renter(s). It is therefore the Renter(s) responsibility to insure against any unforeseen damage or loss of the Renter(s) own possessions

22. The Renter(s) shall give the Owner prompt written notice of any accident, unsafe or dangerous condition, and other defect to the cottage, surrounding property, buildings, equipment, or other chattel belonging to the Owner. The Renter(s) shall be liable for any damage done by reason of water being left running from taps in the rental unit or improper use of appliances, septic system and equipment provided. Only single ply toilet paper is allowed due to the septic system.

23. Owner reserves the right to cancel this booking / “Agreement” at his own discretion.

24. Renter(s) will be responsible for depositing all garbage (Including bottles) in a regulated provincial transfer station. Any garbage (including bottles) left for the owner to dispose of, will trigger a $250 Garbage Disposal fee, which will be deducted from the Security Deposit. Garbage and other foods can and will attract animals such as bear, raccoons, mice, etc. Garbage and food must be sealed to reduce odours, and stowed in “locked down” areas until properly disposed of in a regulated provincial dump. The Renter(s) shall be responsible for any repairs required due to damage relating to the furrowing of animals for food due to improperly stored material. A

25. Severability: If any provisions of this agreement (including rental terms and conditions on

http://www.calabogiepearl.com/... are invalid, such provisions shall be considered separable and the remaining provisions shall remain in full  force and effect.

26. Propane is provided for heating in cooler months and for cooking. It is also provided for BBQ use.

27. The owners are not responsible for situations beyond their control that may, or may not negatively affect the renter stay, such as weather conditions or utility outages due to storms.


Cancellation Policy

1. If the cottage is struck by disaster, or if it is sold prior to occupancy, then all contracts will be null

and void and payments refunded.

2. If the Renter(s) wish to cancel the agreement, he/they must notify the “Owners” in writing and

the following policy shall apply to all cancellations.

(a) If the cancellation is received 3 months or more from the beginning of the cottage occupancy

date. Then all monies will be refunded less an administration fee of $100.00.

(b) If the cancellation is received less than 3 months prior to occupancy then the owners will

endeavour to find a replacement booking for the same time period.

I. If the Owner is successful in a “Complete Re-Booking”, then all monies will be

refunded less a $100 administration fee.

II. If the Owner is successful in a “Partial Re-Booking”, then a partial refund (on a per day

basis) is refunded less the $100 administration fee.

III. If the Owner is unsuccessful in “Re-Booking” the time period, then all monies paid by

the Renter(s) are forfeited. The owner will endeavour to facilitate a future date for

that renter, where the amount already paid can be applied, as credit to a new future

booking at Calabogie Pearl Chalet.


ATTESTATION
By renting, or agreeing to stay at the Calabogie Pearl Chalet, renters and their guests agree to adhere to the terms and conditions listed above. In addition:
I / we agree that we will be responsible for all damages caused by any member of my party or myself

even those amounts that may exceed the “Security/Damage Deposit” provided.

I agree that I will keep the occupied cottage and all furniture, fixtures, chattels, fittings and effects

in/or about the cottage in the same state of repair and condition and as at the commencement of

the occupation of the cottage. I agree to leave the cottage in the same state of cleanliness and

general order in which it was found. I also agree to put all items (especially kitchen utensils, etc) in

the exact place they were found and not to move items around when renting multiple amenities.

I / we agree to abide by all rental terms and conditions as stated.

I / we are aware of the potential risks and assume all liability for any guest/visitor who uses or

participates in activity / equipment (use of the Spa, Sauna, watercraft, swimming, etc) while staying

at Calabogie Pearl Chalets.

I /We are aware of potential risk and will be responsible / liable for any damage/loss incurred to

personal equipment brought to Calabogie Pearl for our personal use. i.e. water craft, gas powered

machines and vehicles etc.

I / We hereby acknowledge that I / we have read and understand all conditions of the above

contract. I / we agree to the Term and Conditions outlined above and will be legally bound by said

agreement. Further more I / we warrant that all personal information provided is true and accurate.


The above contract will be binding, enforceable by law, and take effect once your stay begins at Calabogie Pearl Chalet. 

EQUIPMENT RENTALS / SET-UP & TAKE-DOWN (RESPONSIBILITIES, DAMAGE & INDEMNITY)

Equipment rentals and/or set-up and take-down may be made available by request and subject to approval. Equipment rentals may include, but are not limited to: chairs, tables, dishware, glassware, serving pieces, wedding arch/arbor, flameless candles, décor items, and related accessories (collectively, “Equipment”).

IN CONSIDERATION for being permitted to rent, receive, use, or permit use of any Equipment and/or set-up/take-down services, the booking party, herein referred to as the “undersigned”, for themselves, guests, and invitees, acknowledges and agrees to the following:

  1. INVENTORY & CONDITION (UPON RECEIPT — WITHIN ONE HOUR):
    The undersigned is responsible for confirming quantities and condition of all Equipment upon receipt (within one hour) of delivery or access being provided. Any missing items, damage, defects, or safety concerns must be reported to Suite Harmony within one hour of receipt. Items not reported within that window will be deemed received in good order (ordinary rental wear excepted).
  2. SAFE USE, SUPERVISION & PROPER HANDLING:
    The undersigned is responsible for safe handling, supervision, and use of all Equipment at all times by the undersigned, guests, and invitees. Children must be supervised at all times around Equipment. Equipment must be used only for its intended purpose and in a manner that does not cause damage to the home, decks, grounds, or landscaping.
  3. PLACEMENT & PROPERTY PROTECTION:
    Equipment must not be placed or used in a way that creates hazards or blocks exits, walkways, stairs, decks, docks, or access routes. Do not drag tables or chairs across floors—lift and carry to prevent scratching/scuffing. No tape, nails, screws, staples, or adhesives may be used on walls/ceilings/trim. Please use white sticky putty instead.
  4. FLAMELESS CANDLES ONLY:
    Only flameless candles are permitted. The undersigned is responsible for safe placement and ensuring all flameless candles are turned off and collected at the end of the event/stay.
  5. WEDDING ARCH / LARGE ITEMS:
    The undersigned is responsible for ensuring any arch/arbor and other large items are stable, properly secured/weighted, and safely located. No climbing, hanging, leaning, or attaching loads to any arch/structure is permitted.
  6. DISHWARE / GLASSWARE (RETURN CONDITION):
    Dishware and glassware must be returned clean and in the same state it was received, and returned to the original storage location/containers (as applicable). Any breakage must be reported to Suite Harmony.
  7. SET-UP / TAKE-DOWN PARAMETERS:
    If Suite Harmony provides set-up/take-down, the undersigned must provide clear access at the agreed time(s) and keep guests/invitees away from active set-up/take-down areas for safety. If set-up/take-down is performed by the undersigned or any vendor, the undersigned assumes responsibility for safe handling and for any damage to the property or Equipment caused by the undersigned, guests, invitees, or vendors.
  8. LOSS, THEFT, DAMAGE & FEES:
    The undersigned is responsible for all loss, theft, damage, misuse, staining, breakage, missing items, and excessive wear to Equipment and/or property caused by the undersigned, guests, invitees, or vendors. Suite Harmony may charge for repair, replacement at full replacement cost, cleaning, and/or administrative time, and these charges may be applied to the security deposit and/or charged to the payment method on file as permitted by the booking terms.
  9. RELEASE & INDEMNITY (EQUIPMENT):
    To the fullest extent permitted by law, the undersigned, for themselves, guests, and invitees, agrees that all Equipment and related services are used at their own risk and hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Suite Harmony (2831675 Ontario Inc.) and its members, managers, operators, officials, officers, directors, employees, owners and lessees of the premises (the “releasees”) from all liability for any and all loss or damage, and any claim or demand thereof on account of injury to persons or property or resulting in death, whether caused by negligence of the releasees or otherwise, arising from or related to Equipment and/or set-up/take-down.
    The undersigned further hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees from any loss, liability, damage, or cost they may incur due to the undersigned’s, guests’, or invitees’ use of Equipment and/or set-up/take-down, including damage to the property or Equipment and any claims brought by any guest, invitee, or vendor.

Release & Waiver of Liability & Indemnity Agreement

IN CONSIDERATION for being permitted to enter the property for vacation rental or any other purpose, the booking party, herein referred to as the "RENTER", for themselves, guests, and invitees, acknowledge, agree, and represent that they have or will immediately upon entering, and will continuously thereafter, thoroughly inspect the property and associated amenities, including provided watercraft for safety. Their continued presence constitutes an acknowledgement that they have inspected house, deck and entire property and finds and accepts such areas as being safe and reasonably suited for their use, and they further agree and warrant that if, at any time, they feel anything to be unsafe, they and all guests will immediately leave the area and advise appropriate persons.

THE RENTER hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Suite Harmony (2831675 Ontario Inc.) personally or as company or corporate representatives, their members, managers, operators, officials, officers, directors, employees, owners and lessees of the premises, all for the purposes herein referred to as "releasees", from all liability to the renter, guests, representatives, assigns, heirs and next of kin for any and all loss or damage, and any claim or demand thereof on account of INJURY to the person(s) or property or resulting in DEATH of the undersigned or guests, whether caused by negligence of the releasees or otherwise while in or upon the area.

THE RENTER hereby AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS the releasees and each of them from any loss, liability, damage, or cost they may occur due to their presence in or upon the area and whether caused by the negligence of the releasees or otherwise.

WARNING: Use of all amenities, including but not limited to kayaks, dock, lake, pool, hot tub, fire pit, fireplace, and sauna carry risk that may result in serious injury or death. Unsupervised use by children is prohibited. All persons must wear life vests when in or around the lake. Never use a canoe, kayak, dock, lake, pool, hot tub, sauna, fire pit,fireplace, or sauna while under the influence of drugs or alcohol. Follow all house rules when using amenities

DO NOT WALK ON HOT TUB or POOL COVER as it will collapse. Supervise children at all times to decrease risk of injury or drowning.

SNOW AND ICE MAINTENANCE:
The Renter and their guests acknowledge that while reasonable efforts are made to maintain safe conditions on the property — including snow plowing, sanding, and/or shoveling — Suite Harmony and its associates are not liable for any injuries, damages, or losses to persons or property resulting from snow, ice, or winter-related conditions.

While every effort is made to remove snow and ice in a timely fashion, guests understand that weather conditions, snow removal demands, or other factors beyond Suite Harmony’s control may cause delays in clearing walkways, driveways, or other areas.

The Renter and their guests assume full responsibility for their own safety and that of their guests when entering, exiting, or occupying the property during winter conditions.

By entering the premises, guests waive all claims against Suite Harmony, its owners, agents, employees, contractors, and affiliates for any accident, injury, or damage arising from or related to snow, ice, road conditions, or winter travel to or on the property.

THE RENTER hereby ASSUMES FULL RESPONSIBILITY FOR RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE due to the negligence of the releasees or otherwise while in or upon area.

THE RENTER hereby certifies that they and guests have adequate insurance to cover any injury, illness or damage that may be caused or suffered while in or upon area, or else agrees to bear the costs of such damage or injury. The renter further that they have no medical conditions which would interfere with use of hot tub, swimming, canoeing, hiking, climbing stairs, etc. or else assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or death and/or property damage. The renter further expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by law and that if any provision is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Any dispute, controversy or claim arising out of or related to this Agreement or the interpretation of this Agreement shall be settled by arbitration in accordance to Canadian law, except to the extent modified below. The place of arbitration shall be Ottawa, Canada.

THE UNDERSIGNED HAS READ, UNDERSTANDS THE RISKS, AND VOLUNTARILY AGREES TO THE RELEASE AND WAIVER OF LIABILTY AND INDEMNITY AGREEMENT, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.

By booking a Suite Harmony property, The Calabogie Pearl Chalet or renting equipment, guests agree to adhere to the terms and conditions listed above.

Suite Harmony reserves the right to change these Terms and House Rules at any time, at its sole discretion, without notice. We therefore strongly recommend checking the Terms and House Rules on a regular basis.
